Textualism and Consensualism


The textualists refer to the plain words of the constitutional document, while the consensualists consult a current social consensus on what the words of the document mean.
Textualism and consensualism cannot be useful in “hard cases”, which arise when the words are not plain and when there is not a consensus on the meaning of a provision.
